TERMS OF SERVICE

Playin Bilişim Teknolojileri ve Yazılım Ticaret A.Ş. (“Playin”, “we”, “us”, “our”) is a company registered in Turkey, registered office at;

Playin owns and operates this website and its subdomains of https://www.playin.com.tr (“Website”). By using the Website and any services accessible from the website, you acknowledge that you have read, understood, and agreed to these Terms. Playin may update the Agreement from time to time and it is your responsibility to check for any updates.

You agree that by using the service you represent that either (a) you are at least 18 years old and that you are legally able to enter into this agreement; or (b) if you are under the age of majority in your jurisdiction, your parents have read this agreement and agreed to it on your behalf.

SERVICE

Playin provides playable adverts solutions to its customers. These solutions include development and design of the playable, integration support to ad networks, technical support services and access to creative dashboard owned by Playin. Customer owns the creative rights over the assets provided to Playin, where Playin owns the creative rights over the playable developed unless agreed otherwise in writing between the parties. No warranty is provided over the results of playables on the app stores or third party ad networks.

USER REPRESENTATIONS

By using the Service you represent and warrant that:

  1. All registration information you provide will be true, accurate, current and complete.
  2. You will ensure the information provided is accurate and up to date and update it when needed.
  3. You have the legal capacity and you agree to comply with the Terms of Use.
  4. You will not access the Service using automated means.
  5. You will not use the Service for any illegal or unauthorized purposes.
  6. Your use of the Service will not violate any applicable laws or regulations.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service.

PROHIBITED ACTIVITIES

You may not access or use the Service for any purpose other than that for which we made the Service available. As a user of the Service, you agree not to:

  8. Attempt to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service.
  9. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Service to you.
  10. Copy or adapt the Service's software.
  11. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service.
  12. Use the Service in a manner inconsistent with any applicable laws or regulations.

INTELLECTUAL PROPERTY

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

The Content and the Marks are provided on the Service "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Service and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

SERVICE MANAGEMENT

We reserve the right, but not the obligation to:

  1. Monitor the Service for violations of these Terms of Service.
  2. Take appropriate legal action against anyone who violates the law or these Terms of Service.
  3. Refuse, restrict access to, limit the availability of, or disable any of your contributions or any portion thereof.
  4. Remove from the Service or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems.
  5. Otherwise manage the Service in a manner designed to protect our rights and property and to facilitate the proper functioning of the Service.

TERM AND TERMINATION

These Terms of Use shall remain in full force and effect while you use the Service. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICE TO ANY PERSON FOR ANY REASON OR FOR NO REASON.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action.

THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SERVICE AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, PERSONAL INJURY OR PROPERTY DAMAGE, UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS, INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE, OR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY.

LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the Service, breach of these Terms of Service, or any breach of your representations and warranties set forth in these Terms of Use, including without limitation, your violation of these Terms of Service.

GOVERNING LAW

These Terms of Service shall be governed and construed in accordance with the laws of Turkey. Without affecting your statutory rights, these Terms of Service and the use of this Website are governed by Turkish Law.

DISPUTE RESOLUTION

Any dispute arising from or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts of Turkey.
